Welcome to Eram! The terms "we", "us" and "our" refer to Eram. Eram operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Eram is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNTS

You must be legally capable of entering into a purchase agreement to place an order through our store. Where legally required, minors may only use the Services with the permission of a parent or legal guardian.

You may be asked to provide information such as your name, email address, billing information, payment information, and delivery address.

You confirm that the information you provide is accurate, current, and complete and that you are authorised to provide it.

If you create an account, you are responsible for keeping your login details secure and for activity performed through your account. Please contact us promptly if you believe that your account has been accessed without permission.

You may not sell, transfer, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements, materials, and other information displayed in our store are accurate.

Colours and product appearance may vary slightly depending on your screen, device settings, and the manufacturing or printing process. Minor differences that are inherent to the production process may therefore occur.

These differences do not affect your statutory rights if a product is defective, incorrect, materially different from its description, or otherwise does not conform to the purchase agreement.

Many of our products are produced after an order is placed. The fact that an item is printed on demand does not automatically make it personalised.

A product will generally be considered personalised when it is manufactured using unique customer-provided or customer-selected content, such as a name, personal message, uploaded image, photograph, or individually commissioned design.

We may update product descriptions or discontinue products at any time. Changes will not affect orders that we have already accepted, unless we contact you and agree on an appropriate solution.

Product availability and reasonable purchase limits may apply.

SECTION 3 – ORDERS

When you submit an order, you make an offer to purchase the products included in that order.

After submitting the order, you will receive an electronic acknowledgement. An automated acknowledgement does not necessarily mean that the order has been accepted.

A purchase agreement is formed when we expressly accept your order, normally by sending an order confirmation or beginning production or fulfilment.

We may refuse or cancel an order only on reasonable grounds, including:

  • The product is unavailable;
  • Payment cannot be authorised;
  • The order appears fraudulent;
  • The customer has provided incorrect or incomplete information;
  • An obvious pricing or product-information error has occurred;
  • We cannot deliver to the stated address; or
  • Customer-provided content appears unlawful or infringes third-party rights.

If we cancel an order after receiving payment, we will refund the amount paid using the original payment method.

Please check your order details carefully before submitting the order. Contact us promptly if you notice an error. Changes may not be possible after production or fulfilment has started.

Your rights to cancel or return an order are described in our Return and Refund Policy at [REFUND POLICY LINK]. Nothing in these Terms restricts your statutory right of withdrawal or your rights relating to defective or non-conforming products.

SECTION 4 – PRICES AND BILLING

Prices may be changed before an order is placed. The price applicable to your purchase is the price shown during checkout and confirmed in your order confirmation.

Prices displayed to consumers include VAT where legally required.

Delivery costs and any other mandatory charges will be clearly shown before you submit the order. Customers will not be charged undisclosed mandatory costs.

For deliveries outside the European Union, customs duties, import taxes, or local handling charges may apply. Where these charges are not collected during checkout, the customer may be required to pay them directly to the relevant authority or carrier.

You agree to provide accurate and complete billing, payment, and contact information.

You confirm that you are authorised to use the selected payment method. Orders may not be processed until payment has been authorised.

Payment services may be provided by independent payment providers whose own terms and privacy policies may apply.

SECTION 5 – SHIPPING AND DELIVERY

Production and delivery times displayed on our website are estimates unless we expressly agree to a guaranteed delivery date.

We are responsible for delivering your order within the agreed period or, where no specific period has been agreed, within the period required under applicable law.

Delivery may be affected by carrier delays, customs procedures, public holidays, severe weather, production disruptions, or other circumstances outside our reasonable control. We will take reasonable steps to limit the effect of such delays.

Please contact us if an order is significantly delayed.

The risk of loss or damage remains with Eram until the order is physically received by you or by a person designated by you, other than the carrier.

An exception may apply where you independently appoint a carrier that was not offered by us. In that case, risk may pass when the product is handed to that carrier.

Nothing in this section limits your statutory rights relating to late delivery, non-delivery, damaged products, or cancellation.

SECTION 6 – INTELLECTUAL PROPERTY

The Services and their content, including the Eram name, branding, text, graphics, photographs, product designs, videos, audio, website layout, and other materials, are owned by or licensed to Eram unless otherwise stated.

This content is protected by applicable copyright, trademark, and other intellectual-property laws.

You may access and use the Services for personal, non-commercial purposes.

You may not reproduce, distribute, modify, publish, sell, commercially exploit, or create derivative works from our protected content without prior written permission, except where permitted by law.

Shopify’s names, trademarks, logos, and other intellectual property belong to Shopify or its licensors. Other third-party names and trademarks remain the property of their respective owners.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may provide access to tools or features operated by third parties.

These services may be subject to separate terms and privacy policies. We do not control every aspect of independent third-party tools and cannot guarantee that they will always be available or error-free.

You should review the applicable third-party terms before using such tools.

Nothing in this section removes any responsibility that Eram cannot lawfully exclude, including responsibility relating to an order you place directly with us.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to websites operated by independent third parties.

We do not control those websites and are not responsible for their content, security, availability, or privacy practices.

You should review a third party’s terms and policies before purchasing products or providing personal information through its website.

This section does not apply to parties that we use to perform our own contractual obligations to you. We remain responsible for our obligations as the seller even where we use Shopify, a print provider, a payment provider, or a delivery company.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

Purchases made through this store are made directly from Eram. Eram, and not Shopify, is the seller responsible for accepting and fulfilling your order, providing customer service, and handling statutory consumer rights.

Shopify is not a party to the purchase agreement between you and Eram.

Nothing in this section excludes or restricts rights or remedies that cannot legally be excluded under applicable law.

SECTION 10 – PRIVACY

We process personal information in accordance with our Privacy Policy, available at [PRIVACY POLICY LINK].

Because our store is hosted by Shopify, Shopify may process certain personal information to provide, secure, and improve the ecommerce platform.

We may also share information with production partners, payment providers, carriers, technology providers, and other processors where reasonably necessary to fulfil orders and operate our store.

Our Privacy Policy explains the purposes and legal bases for processing, retention periods, international transfers, recipients of personal information, cookies, and your privacy rights.

SECTION 11 – FEEDBACK AND REVIEWS

You may submit reviews, comments, photographs, suggestions, or other feedback.

You confirm that content you submit:

  • Is based on your genuine experience where presented as a review;
  • Is accurate to the best of your knowledge;
  • Does not infringe third-party intellectual-property or privacy rights;
  • Is not unlawful, misleading, discriminatory, threatening, or defamatory; and
  • Does not contain malware or harmful code.

You retain ownership of your content.

By submitting content for publication, you grant Eram a non-exclusive, worldwide, royalty-free licence to store, reproduce, publish, display, and adapt that content as reasonably necessary to operate, improve, and promote the Services.

This permission continues for as long as the content is used for those purposes, but does not permit us to materially misrepresent the meaning of your review.

We may remove content where we reasonably believe that it is unlawful, fraudulent, irrelevant, abusive, or in violation of these Terms.

We will not falsely present paid, sponsored, or incentivised reviews as independent customer reviews.

SECTION 12 – ERRORS AND INACCURACIES

We may correct typographical errors, inaccuracies, or omissions relating to product descriptions, availability, prices, promotions, delivery charges, or estimated delivery times.

If an error is discovered before we accept an order, we may correct the information and ask you to confirm whether you wish to continue.

If an obvious error affects an order after submission, we will contact you and offer an appropriate solution, which may include confirming the order at the correct price or cancelling it for a full refund.

We will not cancel an accepted order merely because it later becomes less profitable or inconvenient to fulfil.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate intellectual-property, privacy, or other legal rights;

We may reasonably restrict or suspend access to prevent fraud, security threats, unlawful conduct, or material violations of these Terms.

SECTION 14 – AUTOMATED TOOLS AND AGENTS

Automated systems, bots, agents, scraping tools, and similar technologies may not access or interact with the Services in a way that:

  • Violates applicable law;
  • Circumvents technical or security measures;
  • Impairs the operation of the Services;
  • Collects personal information unlawfully;
  • Copies protected content without permission; or
  • places fraudulent or unauthorised orders.

We may use proportionate technical measures to prevent abusive or harmful automated access.

This section does not prohibit ordinary search-engine indexing, accessibility technology, or lawful use that we have authorised.

SECTION 15 – SUSPENSION AND TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access to an account or part of the Services where reasonably necessary because of fraud, security concerns, unlawful activity, non-payment, or a material violation of these Terms.

Where reasonably possible, we will provide notice and an opportunity to correct the issue.

Termination of website access does not cancel an existing accepted order or remove rights and obligations that arose before termination.

Provisions that by their nature are intended to continue after termination—including intellectual-property, payment, privacy, dispute, and liability provisions—will continue to apply.

SECTION 16 – WARRANTIES AND STATUTORY GUARANTEE

We aim to keep the website accurate, secure, and available, but we cannot guarantee uninterrupted or error-free access at all times.

Products supplied to consumers must conform to the purchase agreement and possess the quality, functionality, and characteristics that the customer may reasonably expect.

If a product is defective, damaged, incorrect, or does not conform to the agreement, you may be entitled to a free repair or replacement. Where those remedies are unavailable, disproportionate, or not provided within a reasonable period, you may be entitled to a price reduction or refund.

Nothing in these Terms excludes or limits the statutory guarantee or any other mandatory consumer protection.

SECTION 17 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

This includes liability arising from intent or deliberate recklessness and any mandatory consumer rights relating to defective products, personal injury, death, fraud, delivery, conformity, or refunds.

To the extent permitted by law, Eram is not responsible for losses that:

  • Were not reasonably foreseeable when the agreement was formed;
  • Were caused by incorrect information supplied by the customer;
  • Result from improper or unlawful use of a product;
  • Relate to business activities where the product was purchased primarily for commercial purposes; or
  • Were caused exclusively by circumstances outside our reasonable control.

We remain responsible for the acts of service providers we use to perform our obligations to you to the extent required by law.

SECTION 18 – CUSTOMER-PROVIDED CONTENT AND RESPONSIBILITY

Where you provide a photograph, logo, text, illustration, or other content for a personalised product, you confirm that you own the content or have permission to use it.

You also confirm that producing the requested item will not infringe another person’s copyright, trademark, privacy, publicity, or other legal rights.

You grant us and our production partners a limited permission to use the content only as reasonably necessary to manufacture, fulfil, deliver, and support your order.

Where permitted by law, you may be responsible for reasonable losses resulting directly from customer-provided content that unlawfully infringes third-party rights, but only to the extent that you are legally responsible for those losses.

We may reject content that we reasonably believe is unlawful or infringing.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, it will be removed or limited only to the minimum extent necessary.

The remaining provisions will continue to apply.

SECTION 20 – WAIVER AND AGREEMENT

If we do not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.

These Terms and the policies expressly incorporated into them form the agreement relating to your use of the Services and purchases from Eram.

Nothing in this section excludes statements, information, or commitments that legally form part of the purchase agreement.

SECTION 21 – ASSIGNMENT

You may not transfer your contractual rights or obligations without our consent, except where applicable law gives you the right to do so.

We may transfer our rights or obligations to another business as part of a merger, sale, restructuring, or transfer of the store, provided that this does not reduce your rights or guarantees.

Where required by law, we will inform you of such a transfer.

SECTION 22 – GOVERNING LAW AND DISPUTES

These Terms and purchase agreements made through the Services are governed by Dutch law.

If you are a consumer living in another European Union or European Economic Area country, this choice of law does not remove any mandatory consumer protection available under the law of your country of residence.

Disputes may be submitted to a court that has jurisdiction under applicable Dutch and European law.

Headings are included for convenience and do not limit or change the meaning of these Terms.

The current version of these Terms is available on this page.

We may update the Terms to reflect changes to the Services, our business, or applicable law.

The version applicable to an order is normally the version that was made available when the order was placed.

Changes will not retroactively reduce your rights under an existing purchase agreement.

Where required by law, we will provide notice of material changes.
